Open Letter: Concerns Regarding Mysalesbox Ltd and Spikr Ltd
We are writing publicly to raise concerns about the recent liquidation of Poole based business, Mysalesbox Ltd and the subsequent trading activities of Spikr Ltd. The matters outlined below are allegations that deserve the attention of regulators and the public alike.
1. Continuation of Business Operations
It has been alleged that, while Mysalesbox Ltd entered liquidation with Begbies Traynor Liquidators, with substantial debts outstanding, a substantially similar business began trading almost immediately under the name of Spikr Ltd. Staff, clients, data, funds and operations appear to have been transferred. This has the hallmarks of potential phoenix activity — where one company is shut down leaving behind debts, only for the same directors to continue trading under a new entity.
2. Government Liabilities
Mysalesbox Ltd is understood to have gone into liquidation with unpaid government debts, including tax liabilities. If accurate, this means the public purse shoulders the loss while trading activities allegedly continue elsewhere. Potentially costing the taxpayer potentially over ONE MILLION POUNDS.
3. Employee Redundancy and TUPE
Reports suggest that staff were made redundant at Mysalesbox Ltd, only for similar or identical roles to appear at Spikr Ltd soon after (within 24 hours). This raises serious questions about whether the Transfer of Undertakings (Protection of Employment) Regulations (TUPE) were observed and whether employees’ rights were respected.
The Redundancy Payments Service has confirmed they will not pay the staff their wages, notice or redundancy, leaving employees in financial hardship. The small number of employees not transferred to Spikr Ltd appear to have been those with protected characteristics, including pregnancy.
It is alleged that the directors have attempted to claim over £104,000 for themselves for “loss of wages, redundancy and notice”.
It is alleged that this had been planned for over 8 months with evidence showing the management and directors had been making plans and stopping payments to HMRC.
It is alleged that since payments ceased to employees, directors and management have continued to benefit personally, including reported purchases of high-value vehicles. While others can’t afford their bills. This raises the risk of public funds being lost through what appears to be misuse of the insolvency system. We see this as a gross misuse of the legal system.
4. Data Protection and Privacy
There are allegations that client and employee data was transferred from Mysalesbox Ltd to Spikr Ltd without proper consent or lawful basis. If proven, this would amount to a breach of the UK GDPR and Data Protection Act 2018, putting individuals’ personal information at risk.
It is alleged that The Data Distillery Ltd was used as an intermediary to move finances and data.
5. Why This Matters
These allegations — if substantiated — suggest practices that are both legally questionable and ethically troubling. They touch on four key areas of public concern:
- Fair competition in business.
- Protection of workers’ rights.
- Safeguarding of taxpayer money.
- Respect for data privacy.
6. Call for Regulatory Oversight
We urge the relevant authorities, including the Insolvency Service, HMRC, and the Information Commissioner’s Office, to review these matters thoroughly. Only with full transparency and accountability can trust be maintained in the systems designed to protect workers, creditors, and the public.
We have engaged with multiple Members of Parliament, who have expressed concern over these matters, but we feel that it is important to stand up to this injustice which contributes to the demise of the taxpayer.
